LLW successfully Defends City of Boca Raton’s Beach Renourishment Project

A final order was issued by the Department of Environmental Protection on January 30, 2018 adopting a recommended order from Administrative Law Judge Bram Canter.  Judge Canter had previously ruled in favor of the City of Boca Raton and recommended the Department of Environmental Protection issue a permit modification to allow dredging of the Boca Raton ebb shoal for a central Boca Raton beach renourishment project. This permit modification was challenged by the Town of Hillsboro Beach which claimed the project would cause erosion on the Town’s beaches.  Lewis, Longman, & Walker attorneys, Kevin Hennessy and Richard Green, represented Boca Raton at a two day Administrative Hearing last October and as stated in Judge Canter’s Order, demonstrated that the City “satisfied all applicable regulatory criteria for approval of the proposed modification, including submission of adequate engineering data, a demonstration that no adverse cumulative impacts would result, and a demonstration that the project is not contrary to the public interest.”  Judge Canter further determined that the Town’s alleged injuries “were based on assumptions that were shown to be mistaken.” There was no evidence that the project would have any effect on the town.  Kevin Hennessy and Richard Green are environmental litigators representing parties’ interests in Joint Coastal Permitting matters among other environmental issues.
