SFWMD to Consider Rules that Affect Ch. 298 Districts

December 7, 2022 – The Governing Board for the South Florida Water Management District is poised to consider developing new rules  regarding water inputs into the Southern Florida Flood Control Project (the C&SF system). The agenda  for December 8, 2022, notes the rulemaking seeks to address ongoing operation and maintenance concerns in the C&SF system and to protect the system from “aquatic vegetation, litter, and debris that can lead to blockage of canals and structures.” The agenda description expressly states that the rule is intended to apply to special districts and covers a region that includes Collier, Broward, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Okeechobee, Orange, Osceola, Palm Beach, Polk, and St. Lucie counties.

Lewis, Longman & Walker will continue to monitor this effort to help special districts understand the future implications these rules could have on their operations.
