In a partition action, the court must first determine if the property can be split. If the property cannot be equitably split amongst the multiple owners, then the court will sell the property. For example, if you have a single piece of land with a single home on it, then the property cannot be cut down the middle. In that scenario, the court will have to sell; which will be done and now then it's to a foreclosure sale, which will be a public auction.
